The 2017 California Code implemented 898 new laws by the end of 2016 that left people from all income brackets affected. These laws primarily impacted commercial properties in California.

Disability Access Disclosure in Commercial Leases

Since 2013, landowners are required to have their properties undergo an inspection by a Certified Access Specialist (CASp) at the time of leasing to determine if the property meets all the relevant construction applicability standards.

As per the 2017 California Laws, landowners can now provide a prospective tenant with any inspection report prepared by the CASp beforehand. The inspection report remains valid, given that to the best of the landowner’s knowledge; there have been no changes that could’ve compromised the standards.

The tenant is obligated to keep the report confidential, and may use it only when making changes to the property themselves. The provision of the report is not necessary but the tenant may choose to demand it upon acquiring the lease.

Digital Signatures

The Costa-Hawkins Rental Housing Act 1995 allowed the use of digital signatures but it came in conflict with the Uniform Electronic Transactions Act (UETA) of 1995. The 2017 California Code now allows digital signatures under the 1995 law, to be used as an electronic signature under UETA. The new law also outlines that a public agency is not compelled to accept digital signatures and may choose otherwise.

Re-recording of Documents

When it comes to official property documents, re-recordings are very common. Changes are made for typo errors, illegible text or incorrect information, etc. Previously, there was no proper mechanism for such re-recordings. The 2017 California Code maintains that any re-recording be executed as a new document unless it’s for a minor mistake, in which case it can be exempted from the acknowledgment requirements.

Notary Fees

Notary services for verification are necessary for property transactions. The 2017 California Code increased the notary fees from $10 to $15.
